1. Information We Collect
We collect information customers provide directly, including their name, telephone number, email address, Hong Kong delivery address, order details, product preferences, correspondence, return evidence, and refund instructions. Required fields should be identified when information is requested. If necessary information is withheld, we may be unable to accept an order, complete delivery, or process a request.
Our website may automatically receive device type, browser information, internet protocol address, pages viewed, referral source, approximate location, and interaction data through server logs, cookies, or similar technologies. We do not collect online card information because purchases are completed through Cash on Delivery.
2. Why We Use Personal Data
Orbiskicks uses personal data to:
- receive, prepare, and administer orders;
- coordinate free delivery within Hong Kong;
- communicate dispatch and delivery information;
- manage Cash on Delivery records;
- address failed deliveries and order disputes;
- assess eligible returns and arrange exchanges;
- transfer refunds when replacement stock is unavailable;
- respond to questions and exercise legal rights;
- maintain website functionality and prevent misuse; and
- satisfy accounting, record-keeping, and legal obligations.
We use personal data only for the stated purpose, a directly related purpose, or another purpose permitted by law. Where prescribed consent is required for a new purpose, we will seek it before that use.
3. When Information Is Shared
We may disclose limited personal data to courier providers, website hosts, communications vendors, professional advisers, banking providers handling refunds, public authorities, or other service providers performing tasks for Orbiskicks. Each recipient should receive only information reasonably required for its role.
We do not sell or rent personal data.
4. Retention and Disposal
Personal data is retained only as long as reasonably necessary for the collection purpose, operational requirements, dispute management, or applicable legal obligations. Retention periods vary according to the record. When information is no longer required, Orbiskicks will take practicable steps to delete, anonymize, or securely dispose of it, unless continued retention is permitted or required by law.
Bank details supplied for a refund are used for that transfer, related records, and dispute handling. They are not used to process the original Cash on Delivery purchase.
5. Data Accuracy and Security
Customers should provide current and accurate information and notify us of relevant changes. Orbiskicks takes reasonably practicable administrative, organizational, and digital measures to protect personal data against illegal access, processing, loss, alteration, disclosure, or destruction. However, no internet transmission or storage method can eliminate every risk.
6. Direct Marketing Choices
Orbiskicks will use personal data for direct marketing only after providing the information required by law and obtaining the customer’s consent or indication of no objection where applicable. Marketing messages will identify an available opt-out method. Customers may withdraw consent without charge by using that method or emailing footwear@orbiskicks.com. The request will not affect service messages concerning an existing order, delivery, return, or refund.
Commercial electronic messages with a Hong Kong link will be managed with regard to the Unsolicited Electronic Messages Ordinance (Cap. 593) and related requirements.
7. Access and Correction Rights
Under the Personal Data (Privacy) Ordinance, individuals may request access to personal data held about them and request correction of inaccurate data. Requests should be sent to footwear@orbiskicks.com with enough information to identify the relevant records. Orbiskicks may request identity evidence, follow prescribed procedures, charge a permitted fee, or refuse a request where the law allows. A reason will be provided when legally required.
8. Legal Framework
This policy is governed by Hong Kong law, principally the Personal Data (Privacy) Ordinance (Cap. 486) and its six Data Protection Principles concerning collection, accuracy, use, security, openness, access, correction, and retention. Electronic records are addressed under the Electronic Transactions Ordinance (Cap. 553). The Trade Descriptions Ordinance (Cap. 362) applies to fake commercial representations, including relevant privacy statements.
